How WHS law works in Victoria
Victoria has not adopted the national model WHS laws. Workplace safety in Victoria is governed by the Occupational Health and Safety Act 2004 and the Occupational Health and Safety Regulations 2017, administered by WorkSafe Victoria. The terminology is different too — Victorian law refers to employers and self-employed persons rather than a person conducting a business or undertaking (PCBU).
On construction projects costing $350,000 or more, the principal contractor must prepare a health and safety coordination plan, and SWMS are required for high risk construction work under Part 5.1 of the OHS Regulations. From 1 December 2025, the Occupational Health and Safety (Psychological Health) Regulations 2025 require Victorian employers to identify psychosocial hazards and control the associated risks, and information, instruction or training cannot be the only or main control unless other measures are not reasonably practicable.
Documents for Victorian clients are written to the Victorian OHS framework — not a harmonised template with the state name changed.
