How WHS law works in Western Australia
Western Australia's Work Health and Safety Act 2020 and its regulations took effect on 31 March 2022. They align closely with the national model laws and apply to all workplaces in WA, including mines and petroleum and geothermal energy operations. The WorkSafe Commissioner is the regulator, supported by WorkSafe WA.
WA's laws include an industrial manslaughter offence, which reinforces the importance of having genuine, working safety systems rather than paperwork that sits in a drawer.
WorkSafe WA has also flagged new workplace exposure limits for hazardous chemicals taking effect on 1 December 2026 — a good prompt to review your hazardous chemicals register and related SWMS and risk assessments.
