How WHS law works in New South Wales
In New South Wales, work health and safety is governed by the Work Health and Safety Act 2011 (NSW) and the Work Health and Safety Regulation 2025 (NSW), administered by SafeWork NSW. The 2025 Regulation replaced the Work Health and Safety Regulation 2017 in 2025, so safety documents that still cite the 2017 Regulation should be reviewed and updated.
The NSW Regulation departs from the national model in some areas. For example, psychosocial risks in NSW must be managed in accordance with the hierarchy of control measures, and businesses carrying out high risk processing of crystalline silica substances have an information-sharing duty linked to the NSW silica worker register.
